Couple says Simakas driver failed to control vehicle, causing crash

MOUNDSVILLE — A Martins Ferry couple is suing Mark Bartrug and Simakas Co. Inc., citing alleged insufficient measures were taken to prevent injuries.

James Markus and Mary K. Markus filed a complaint Jan. 17 in Marshall Circuit Court against the defendants alleging Bartrug breached his duty to exercise reasonable care in the operation of the vehicle.

According to the complaint, the plaintiffs allege that on Nov. 25, 2015, James Markus was severely injured after Bartrug negligently drove his truck at an intersection near Axiall's Natrium plant in Proctor. As a result, he has suffered physical and mental pain, lost wages and loss of enjoyment of life. Mary Markus suffered loss of society and comfort of her husband. The plaintiffs holds Mark Bartrug and Simakas Co. responsible because Bartrug allegedly failed to keep proper lookout and failed to maintain proper control of his vehicle.

The plaintiffs request a trial by jury and seek compensatory damages, pre- and post-judgment interest, attorney's fees, costs and all other proper relief. They are represented by Scott S. Blass and John E. Artimez of Bordas & Bordas PLLC in Wheeling.
