WHEELING — A Wheeling woman is suing Navient Solutions Inc., citing alleged unconscionable debt collection.
Rebecca L. Brogan-Johnson filed a complaint Jan. 17 in Ohio Circuit Court against Navient Solutions alleging the debt collector breached the contractual terms of her student loan.
According to the complaint, Brogan-Johnson alleges that she has suffered and will continue to suffer monetary damages for paying an increasing monthly payments. The plaintiff holds Navient Solutions responsible because the defendant allegedly overbilled her by applying a student loan interest rate that is higher than the contracted interest rate and refused to provide loan history and amortization schedule.
Brogan-Johnson requests a trial by jury and seeks compensatory, actual, punitive and statutory damages, cancellation of debt, attorney's fees, costs and such other relief. She is represented by Frank X. Duff and Sandra K. Law of Schrader Byrd & Companion PLLC in Wheeling.
