Tire store claims business failed to pay entire balance of purchase

NEW MARTINSVILLE — A Wetzel County tire store is suing Mid South Carbon Corp., a trucking company, citing alleged breach of contract.

Stone Caves, Inc. doing business as Red's Tire and Truck Service, filed a complaint Jan. 17 in Wetzel Circuit Court against Mid South Carbon Corporation, alleging it failed to pay for remaining purchases.

According to the complaint, Stone Caves alleges that between May 27 and Aug. 1, the defendant purchased tires from the plaintiff and made only three payments. No other payments have made, and the defendant owes the plaintiff $32,049.04, the complaint states. The plaintiff holds Mid South Carbon Corp. responsible because the company allegedly failed to perform its obligation to pay the total amount owed.

The plaintiff requests a trial by jury and demands judgment against the defendant in the amount of $32,049.04 plus interest and costs. The company is represented by Logan Hassig of Snyder and Hassig in New Martinsville.
