Man says nursing home delayed emergency care for father

CHARLESTON — A Fairmont man is suing a nursing home and its parent company, citing alleged breach of duty and negligence.

Chester A. Brown filed a complaint Jan. 19 in Kanawha Circuit Court against 1543 Country Club Manor Operations LLC d/b/a Pierpont Centre at Fairmont Campus and Genesis Healthcare LLC, alleging they failed to provide proper care and assessment.

According to the complaint, Brown alleges that on Nov. 23, 2015, David A. Brown, his father was admitted to Pierpont Centre, where his health deteriorated and suffered from infection of pressure-related skin injuries, recurrent urinary tract infections and weight loss causing significant injuries, ultimately leading or contributing to his death. The plaintiff holds the nursing home responsible because the defendants allegedly committed statutory violations and reckless misconduct, failed to provide proper supervision and delayed emergency care.

Brown requests a trial by jury and demands judgment against defendant and seeks all damages allowable under West Virginia law any other items and relief that the court sees fit. He is represented by Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm in Charleston.
