WHEELING — A woman is suing Wheeling Park Commission, citing alleged insufficient measures were taken to prevent injuries.
Michelle L. Rushman filed a complaint Jan. 19 in Ohio Circuit Court against Wheeling Park Commission, alleging that park operator failed to provide warning signs for an uneven walkway.
According to the complaint, Rushman alleges that on July 23, she attempted to walk at night on the sidewalk in front of the newly renovated West Lodge but fell off the edge of the offset sidewalk. The offset step down was latent and could not be seen due to the lack of lighting or warning and has similar coloration of the sidewalk. As a result, plaintiff fractured her right ankle and suffered other injuries. Rushman holds Wheeling Park Commission responsible because the defendant allegedly failed to warn or otherwise protect her from the condition of the sidewalk.
Rushman requests a trial by jury and seeks judgment against the commission in an amount in excess of jurisdictional limit and seeks interest, costs and such other and further relief as this court deems just and proper. She is represented by Donald J. Tennant Jr. of Tennant Law in Wheeling.
