Bluefield resident accuses Maples Health Care of wrongful death

PRINCETON — A Bluefield man is suing Maples Health Care Inc., citing alleged insufficient measures were taken to prevent injuries and negligence.

Dean Pennington, son and personal representative of the estate of Olive Pennington, filed a complaint on Jan. 17 in the Mercer Circuit Court against Maples Health Care, alleging that the nursing home facility failed to comply with the acceptable professionals standards and principles.

According to the complaint, Pennington alleges that during Olive Pennington's residency at Maples Health Care facility, she suffered respiratory systematic abuse and neglect, causing significant injuries, ultimately leading to her death on Oct. 21, 2015. The plaintiff holds Maples Health Care responsible because the defendant allegedly failed to provide adequate and appropriate nursing care and failed to provide close monitoring and emergency care.

Pennington requests a trial by jury and seeks all damages allowed by law and all other items that the court sees fit to award. He is represented by Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
