Son blames father's injuires on nursing facility operators

CHARLESTON — A father and son are suing New Martinsville nursing facility operators, alleging medical malpractice and negligence.

Robert Deegan II and Robert Deegan filed a lawsuit Jan. 9, in the Kanawha Circuit Court against Genesis Healthcare LLC, Sunbridge Mountain Care Management Inc., John Does 1-10, unidentified entities 1-10  and New Martinsville Healthcare Center, alleging they breached their duty to properly manage and operate the nursing home facility.

According to the complaint, Robert Deegan sustained personal injuries and damages while a resident at New Martinsville Healthcare Center between Feb. 1-Sept. 15, 2016. The suit says he has suffered deterioration of health and physical condition, resulting in physical and emotional trauma. 

The plaintiffs allege the defendants failed to adopt and implement appropriate policies and procedures, and failed to take corrective actions when problems were brought to their attention.

The Deegans seek trial by jury, compensatory and punitive damages in an amount to be proven at trial, plus costs of court and all such other equitable relief. They are represented by attorneys James B. McHugh, Michael J. Fuller Jr. and D. Bryant Chaffin of McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi.
