WILLIAMSON – A woman is suing the Mingo County Board of Education after she claims her daughter was slapped and injured by a school's new principal.
Daniel Dean, the principal at Mingo Central High School, also was named as a defendant in the suit. Dean became principal at MCHS on Jan. 1.
On Jan. 20, H.R. was involved in an altercation at Mingo Central High School and Dean came and got her and took her to the principal’s office, shut the door and began to talk to her in a threatening manner, according to a complaint filed Feb. 1 in Mingo Circuit Court.
Amanda Davis claims Dean proceeded to talk down to H.R., screaming in her face and, at one point, slapping her in the face and knocking her to the floor.
H.R. was delusional and confused immediately following the alleged slap and reached for help to pick herself up off the floor, according to the suit.
Davis claims a witness to the event went on to say, “Wow, he went too far,” speaking of Dean’s actions.
H.R. suffered severe bodily injury as a result of the assault, battery and intentional act by Dean and she also sustained grievous bodily injuries as a result of the attack, according to the suit.
Davis claims H.R.’s injuries were a direct and proximate result of the defendants’ failures.
Dean acted in a manner that was inconsistent with the policies and procedures of the State of West Virginia Board of Education, the Mingo County Board of Education and he violated numerous criminal codes under the West Virginia Code, according to the suit.
Davis claims the West Virginia State Police are investigating Dean for criminal actions stemming from the incident.
Dean was negligent and the Board of Education was negligent in failing to supervise its employees and students, according to the suit.
Davis is seeking compensatory and punitive damages. She is being represented by Justin J. Marcum of Marcum Law Office.
