Woman sues Genesis Healthcare for grandmother’s injuries, death

CHARLESTON – A granddaughter is suing Genesis Healthcare after she claims they are responsible for her grandmother’s injuries and death.

Sunbridge Dunbar Health Care Corp.; John Does 1 through 10; and Unidentified Entities 1 through 10, as to Dunbar Care and Rehabilitation Center, were also named as defendants in the suit.

Glenda Roberts was a resident of the defendant from Sept. 4, 2015, through Jan. 31, 2016, and suffered personal injuries and damages while a resident there. She died on Feb. 14, 2016, according to a complaint filed in Kanawha Circuit Court.

Erin Graley, Roberts’ granddaughter, claims Roberts was admitted to the facility when she was 76 years old due to her medical condition and her need for adequate care.

Graley claims Roberts suffered pneumonia, fractures and, eventually, her death due to the facility.

The defendants were aware of the dangerous environment that was created by their methods of management and/or control at all their facilities and the defendants owed a duty to residents to act in a manner consistent with the proper operation of the nursing homes they controlled, according to the suit.

Graley claims as a direct and proximate result of the negligence of the defendants, Roberts suffered injuries, including pneumonia, fractures, extreme pain, suffering, mental anguish, embarrassment and fright, all of which required hospitalization and medical treatment and required her to incur significant hospital and medical expenses.

The defendants’ actions constituted medical malpractice and failed to meet the standard of care, according to the suit.

Graley is seeking compensatory and punitive damages. She is being represented by James B. McHugh and Michael J. Fuller Jr. of McHugh Fuller Law Group.
