Cabell County Board of Education blamed for fall

HUNTINGTON — A Huntington woman is suing the Cabell County school board, alleging its negligence led to injuries for the plaintiff. 

Debra A. Childers filed a complaint Jan. 25 in Cabell Circuit Court against the Cabell County Board of Education alleging failure to maintain its premises in a safe condition.

According to the complaint, on Jan. 27, 2015, Childers was walking across the parking lot to enter Barboursville Middle School when she fell on unseen ice. The fall caused her to sustain severe and permanent injuries to her back and head, the suit says. 

The plaintiff alleges the board of education failed to adequately remove ice and snow from the pathway and failed to provide warning signs of the danger presented by the unforeseen ice.

Childers seeks trial by jury, compensatory damages, attorney fees and court costs, pre- and post-judgment interest and all other equitable relief. She is represented by attorney John D. Hoover of Hoover Andrews PLLC in Barboursville.
