Partnership, trustee accuse partner of breach of duty

KINGWOOD — A partnership business and trustee are suing a partner, alleging breach of duty.

The Mary Jane Marrara Irrevocable Trust, by Rocco S. Marrara Jr., its trustee and Fountain Service Station filed a complaint Jan. 11 in Preston Circuit Court against The Domenick Marrara Jr. Trust, by its trustee, Domenick Marrara Jr. alleging the partner intentionally violated the law.

According to the complaint, the defendant's wrongful conduct adversely and materially affected Fountain Service Station's business operation. The plaintiffs allege between 2011 and Jan. 20, 2015, Dominick Marrara Jr. made numerous payments to entities under his control.

The plaintiffs seek trial by jury, the expulsion and disassociation of Marrara as partner of Fountain Service Station, award for The Mary Jane Marrara Irrevocable Trust's share of income, costs of court and all other appropriate relief. They are represented by attorney William J. Leon of Morgantown.
