KINGWOOD — A couple and their car passenger are suing the state department of highways and a driver, alleging their negligence led to a crash that injured the plaintiffs.
Jody Sue Lehmann, Mark Lehmann and Brandon Lee Haskiell filed a complaint Jan. 25 in Preston Circuit Court against the West Virginia Department of Highways and Allen Ray Teets, alleging the Highways Department carelessly entrusted its vehicle to a negligent driver.
According to the complaint, on Jan. 28, 2015, Jody Lehmann was driving a motor vehicle in which Haskiell was a passenger on state Route 26 in Preston County. The suit says Teets, a highways department employee, negligently struck their vehicle. As a result, the suit says, Jody Lehmann and Haskiell sustained severe injuries that resulted in great physical pain, mental anguish and medical expenses.
The lawsuit states Mark Lehmann suffered loss of consortium, companionship and service of his wife. The plaintiffs allege Teets negligently and carelessly operated the motor vehicle and failed to avoid the accident.
The plaintiffs seek trial by jury, compensatory damages that will fully and adequately compensate the plaintiffs' damages, together with costs of court, and pre- and post-judgment interest.
