Kanawha County woman alleges assisted living facility failed to provide appropriate care

WINFIELD — A Kanawha County resident is suing assisted living facility operators, citing alleged insufficient measures were taken to prevent injuries.

Deborah L. Adkins, as personal representative of the estate of Betty F. Lore, filed a complaint on Jan. 25 in the Putnam Circuit Court against Bellaire at Devonshire AL LLC, Cathcart Group and Beacon Communities of West Virginia Inc., et al alleging that they breached their duty to provide decedent Lore with her resident's rights.

According to the complaint, the plaintiff alleges that beginning in May 22, 2015, Lore was a resident at the defendant's facility. During that time, she sustained serious and significant injuries that ultimately contributed to her death on May 15, 2016. The plaintiff holds the defendants responsible because they allegedly failed to provide a safe environment, failed to ensure Lore was free from abuse and neglect and failed to provide adequate and appropriate health care and services.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees and costs as well as other relief that the court sees fit to award. She is represented by Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
