Father accuses sheriff's deputy of violating law

CHARLESTON — A Franklin County man is suing a Raleigh County sheriff's deputy, alleging deprivation of liberty without due process.

Kevin A. Lambert filed a complaint Feb. 6 in U.S. District Court for the Southern District of West Virginia against R.E. Hall, alleging violation of the Fourth and 14th Amendments to the U.S. Constitution.

According to the complaint, on Feb. 5, 2015, Lambert was falsely arrested, indicted and arraigned based on false information. As a result, the suit says, he has suffered economic damages for posting a bond and travel expenses as well as emotional distress concerning the sole custody of his two sons. 

The plaintiff alleges Hall made reports with the intent to inflict unnecessary harm and humiliation to Lambert and deprived him of his right to be free from excessive and unreasonable police actions.

Lambert seeks trial by jury, judgment against defendant in an amount to be determined at trial, costs of court and all other proper relief. He is represented by attorney Scott H. Kaminski of Kaminski Law PLLC in Charleston.
