Silver Spring residents says Mexican restaurant operators failed to pay minimum wage

MARTINSBURG — Silver Spring residents are suing restaurant operators, citing alleged violation of workers compensation acts.

Alejandro Ramirez Benitez and Rey Ramirez Benitez filed a complaint on Feb. 2 in the U.S. District Court for the Northern District of West Virginia against Las Trancas of Martinsburg Inc., El Ranchero of Hagerstown II Inc. and Jose Humberto Munoz, alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they typically worked for defendants for 65 to 70 hours per week without receiving proper compensation for all hours worked over 40 per workweek. The plaintiffs hold the defendants responsible because they allegedly failed to pay them the required minimum wage rate and for all non-overtime hours worked.

The plaintiffs seek compensation for all unpaid wages in an amount to be proven at trial, plus liquidated damages, attorney's fees and costs and such other appropriate relief.
