FAYETTEVILLE — A Virginia mining equipment manufacturer is suing a parts supplier, alleging breach of a consignment agreement.
J.P. Industries Service Inc. of Lynchburg, Virginia, filed a lawsuit Jan. 26 in Fayette Circuit Court against H&M Mining Supply Inc. and W.R. Murdock & Sons Inc., doing business as Murdock Hydraulics, alleging failure to perform their obligations under an agreement.
According to the complaint, on Nov. 30, 2015, Murdock Hydraulics accepted parts from the plaintiff, on behalf of Mining Supply, in the amount of $63,500, for the purpose of sale. As a result of the defendants' failure to account for the parts, J.P. Industries was damaged monetarily.
The plaintiff alleges the defendants have failed to respond to its request for an accounting of liquidated parts and failed to return parts that are not liquidated.
J.P Industries Services seeks trial by jury, judgment, jointly and severally, for the return of the parts belonging to plaintiff that are currently in the defendants' possession, pre- and post-judgment interest, litigation expenses and all other proper relief.
