Nursing home operators accused of negligence

CHARLESTON — A Fayette County woman is suing Oak Hill nursing home operators, alleging negligence led to injuries for a resident. 

Yvonne Hill, as power of attorney of Mary Henderson, filed a complaint Jan. 26 in Kanawha Circuit Court against 422 23rd Street Operations LLC, doing business as Hidden Valley Center, and Genesis Healthcare LLC, alleging they breached their duty to uphold Henderson's nursing home resident's rights.

According to the complaint, on April 26, 2016, Henderson was admitted to Hidden Valley Center for rehabilitation and assistance. During the time she was a resident under the defendants' care, the suit says, Henderson suffered dehydration, shin injuries, mental anguish and medical expenses. 

The plaintiff alleges the defendants failed to provide a safe environment, failed to provide adequate supervision and safety devices to prevent Henderson from dehydration and injuries, and failed to provide appropriate health care services.

Hill seeks trial by jury, judgment for all lawful damages, litigation costs and all other equitable relief. She is represented by attorneys Andrew Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
