Policyholder alleges Prudential violated workers' compensation acts

WILLIAMSON — A Kentucky woman is suing Prudential Insurance, alleging violation of workers compensation acts.

Deborah L. Foley filed a complaint Jan. 26 in Mingo Circuit Court against Prudential Insurance Company of America, alleging it breached the terms of the workers compensation law.

According to the complaint, Foley, who worked at Health Management Associates Inc. in Mingo County,  was an eligible employee under the employee welfare benefit plan, but Prudential arbitrarily denied her entitlement to disability benefits.

Foley seeks trial by jury, all benefits due to her under the plan, pre-judgment interest, attorney fees and court costs and all other appropriate relief. She is represented by attorney John J. Polak of Atkinson & Polak PLLC in Charleston.
