WEST UNION — Two Salem residents are suing Ford Motor Co., citing alleged breach of express and implied warranties.
Richard and Briana Hausler filed a complaint on Jan. 27 in the Doddridge Circuit Court against Ford Motor Co. alleging that the vehicle manufacturer violated the West Virginia Motor Vehicle Warranty Act.
According to the complaint, the plaintiffs allege that on Jan. 4, 2016, they purchased a 2016 Ford Explorer for approximately $44,735. Shortly after purchase, the plaintiffs experienced repeated problems with the quality and workmanship of the vehicle and such problems substantially impaired its use, value and safety. The plaintiffs suffered loss of use of the vehicle. The plaintiffs hold Ford Motor Co. responsible because the defendant allegedly has been unable to repair the vehicle to conform it with its warranties and refused to replace it with a comparable one.
The plaintiffs request a trial by jury and seek revocation of acceptance and a refund for the purchase price and other consequential expenses, award for punitive damages, attorney's fees, interest and such other necessary relief.
