WINFIELD — Putnam County property owners are suing construction companies, alleging negligence and reckless conduct.
Sidney Baldwin and Connie L. Thomas Baldwin of Cabell County filed a complaint Jan. 27 in Putnam Circuit Court against FTL Ltd. Inc., Shamblin Stone Inc., and Patriotics LLC, alleging failure to perform work in a professional manner to avoid damages.
According to the complaint, on April 7, 2016, the Baldwins contacted Patriotic Buildings to have a metal garage with a gravel floor built on the their Putnam County property. During the construction, the suit says, FTL delivered the ordered stone from Shamblin weighing approximately 72,940 pounds on a triple-axle dump truck across a small bridge. As a result, the bridge collapsed causing extensive to the plaintiff's property, the lawsuit states.
The plaintiffs allege the defendants showed willful, wanton and reckless disregard for the property despite the Baldwins' request and refuse to turn the matter over to its liability insurance carrier.
The Baldwins seek trial by jury, repair of the bridge in the amount of $8,405, plus interest, costs of court and punitive damages. They are represented by attorney David L. Hill of Hurricane.
