Customer accuses GM of breach of warranties

PINEVILLE — A Wyoming County woman is suing General Motors, alleging breach of express and implied warranties.

Tabatha L. Lester of Davin filed a complaint Feb. 2 in Wyoming Circuit Court against General Motors LLC, alleging the vehicle manufacturer failed to comply with the provisions of the West Virginia Consumer Protection Act.

According to the complaint, on Sept. 17, 2015, Lester purchased a new 2015 GMC Yukon for $72,695 from a dealer in Chapmanville. Since the purchase, the suit says, the vehicle has been subject to repair for the same defect on at least three occasions. As a result, the lawsuit states, Lester has suffered the loss of use of the vehicle, annoyance and inconvenience. 

The plaintiff alleges General Motors failed to repair the vehicle in a good and workmanlike manner, so as to bring it in conformity with its warranties.

Lester seeks trial by jury, an order for the proper rejection of the vehicle or revocation of acceptance, damages, costs of court and all other just and appropriate relief. She is represented by attorney David G. Thompson of Pineville.
