Estate representatives blame nursing home operators for woman's death

HUNTINGTON — Two estate representatives are suing nursing home facility operators, alleging the defendants failed to protect or prevent injuries for a resident.

Debbie Ray and Aaron Ray, as personal representatives of the estate of Carol Sanders, filed a complaint Feb. 2 in Cabell Circuit Court against Huntington Health and Rehabilitation Center, SavaSeniorCare Administrative Services LLC, et al, alleging they breached their mandated duty to provide assisted living facility rights to Sanders.

According to the complaint, between March 7-April 29, 2016, Sanders was under the care of Huntington Health and Rehabilitation Center. During that period, the suit says, she suffered abuse and neglect resulting in physical injuries, mental anguish and medical expenses. She died May 1, 2016. 

The plaintiffs allege the defendants failed to provide adequate and appropriate health care and protective services and failed to provide adequate supervision and assistance devices to prevent accidents.

The Rays seek trial by jury, judgment for all damages allowable by law, punitive damages, costs of court and other proper relief. They are represented by attorneys Andrew L. Paternostro, Jeff D. Stewart and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston.
