Customer blames retailer, snow removal contractor for injuries

FAYETTEVILLE — A Fayette County man is suing a retailer and snow removal contractor, alleging their negligence caused him to be injured. 

Kelly Eastman of Ansted filed a complaint on Jan. 27, in the Fayette Circuit Court against Dolgencorp LLC and John Doe Snow Removal Company, alleging that they breached their duty of care to maintain the premises in a safe condition, clear of snow and/or ice.

According to the complaint, on March 3, 2015, while entering Dolgencorp's establishment in Ansted, Eastman fell on ice and/or snow, causing him to sustain injuries to his left elbow and arm and medical bills of more than $75,000. The plaintiff alleges the defendants failed to clear ice and/or snow that accumulated on the property.

Eastman seeks trial by jury, judgment, jointly and severally, for compensatory damages in an amount to be proven at trial. He is represented by attorney Anthony M. Salvatore of Hewitt & Salvatore PLLC in Fayetteville.
