Daughter blames nursing facility operators for mother's injuries

Medical malpractice 01

CHARLESTON — A daughter is suing South Charleston nursing facility operators, alleging negligence led to serious injuries for her mother.

Lorna Lynch, on behalf of Rosalene Barnes, filed a complaint Feb. 2 in Kanawha Circuit Court against Genesis Healthcare LLC, 1000 Lincoln Drive Operations LLC, et al, alleging failure to properly operate the nursing home they controlled.

According to the complaint, between March 14-Oct. 6, 2015, Barnes was a resident at Valley Center in South Charleston. While a resident there, the suit says, she suffered catastrophic injuries, disfigurement, extreme pain and mental anguish.

The plaintiff alleges the defendants failed to ensure that Barnes was protected from accidental and intentional injuries and failed to provide adequate hygiene and sanitary care.

Lynch seeks trial by jury, compensatory and punitive damages plus costs of court, and all other just relief. She is represented by attorneys James B. McHugh, Michael J. Fuller, D. Bryant Chaffin, Ka'Leya Q. Hardin, Kendra R. Fokakis, Amy Quezon, A. Lance Reins and John R. Cummings of McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi.
