Couple alleges contractor, sellers breached contract

WINFIELD — A Putnam County couple is suing a contractor and sellers, alleging fraud and civil conspiracy.

Brian R. Ritz and Karin M. Ritz filed a complaint Feb. 2 in Putnam Circuit Court against BPI Inc., John C. Wells and Kristen N. Wells, alleging they breached all the contractual requirements under the terms of a contract.

According to the complaint, on May 26, 2016, Brian and Karin Ritz purchased a home in Putnam County from Wells, which was constructed and warranted by BPI. Shortly after the purchase, the suit says, the Ritzes discovered material defects that made the home inhabitable and unsafe. To date, no repairs have been performed by the defendants, the lawsuit states. 

The plaintiffs allege Wells represented that the property has no material defects and BPI provided lifetime warranties to the property.

The Ritzes seek trial by jury, compensatory and punitive damages, and all other just and proper relief. They are represented by attorney Timothy J. LaFon of Ciccarello, Del Giudice & Lafon in Charleston.
