NEW MARTINSVILLE — A Wetzel County woman is suing a recycling business and a driver, alleging their negligence caused a crash that injured the plaintiff.
Roberta Wagner, individually and as guardian, mother and next of friend of minors Melinda Hubbard and Joseph Hubbard, filed a complaint Feb. 8 in Wetzel Circuit Court against Lawrence C. Stroud and Wood Waste Recycling LLC, alleging Stroud failed to operate his motor vehicle in accordance with the Motor Vehicle Code.
According to the complaint, on Feb. 11, 2015, Wagner was lawfully operating her 2006 Ford Fusion vehicle on state Route 2 in New Martinsville when Stroud, a driver for Wood Waste, crashed his vehicle into the plaintiff's car. As a result, the suit says, Wagner suffered physical injuries that prevented her from carrying out duties and responsibilities as a mother to her two children.
The plaintiffs allege Stroud failed to maintain control of the motor vehicle, failed to yield the right of way and failed to keep a reasonable and proper lookout for other motor vehicles.
Wagner seeks trial by jury, compensatory damages in excess of the minimum jurisdictional limit, plus pre and post-judgment, court costs and all further just relief. She is represented by attorney Theodore L. Tsoras of Tsoras Law Office in Powhatan Point, Ohio.
