HUNTINGTON — A Huntington motorcycle driver is suing 5 Star Pizza, doing business as Domino's Pizza, and Mike Smith, alleging their negligence caused injuries to the plaintiff.
Michael A. Berlin filed a lawsuit Feb. 10 in Cabell County Circuit Court against 5 Star Pizza doing business as Domino's Pizza and Mike Smith, alleging Smith failed to operate his Domino's delivery vehicle properly.
According to the complaint, on March 16, 2016, Berlin was traveling eastbound in the 1800 block of 6th Avenue in Huntington when Smith drove his Domino's delivery vehicle directly in front of plaintiff's motorcycle. As a result, the suit says, Berlin suffered physical injuries, damages to personal property and incurred medical expenses.
The plaintiff alleges Smith failed to properly abide all road signs and laws, failed to keep a proper lookout for other motorists and failed to operate a delivery vehicle at a safe speed.
Smith seeks trial by jury, reasonable compensation for his injuries and damages, plus pre-judgment interest and court costs. He is represented by attorneys Abraham J. Saad and Adam I. Slone of of Saad Dixon Law Offices PLLC in Huntington.
