BECKLEY — A Virginia truck driver is suing a North Carolina truck business and one of its drivers, alleging their negligence caused injuries to the plaintiff.
Douglas Saunders filed a complaint Feb. 8 in U.S. District Court for the Southern District of West Virginia against Bryce T. Horton Trucking LLC and Adrian Winston Thompson Sr., alleging Thompson carelessly operated the vehicle, causing it to eject multiple logs from his trailer.
According to the complaint, on Feb. 25, 2015, while Saunders was driving south on Interstate Highway 77 in Raleigh County, he was struck with multiple logs that were lying in the travel lanes of the highway. As a result, the suit says, he suffered physical injuries, mental anguish and medical expenses.
The plaintiff alleges Thompson failed to secure his load properly, drove at an excessive, unsafe and unreasonable speed, and that Horton Trucking failed to adequately educate, train, audit and supervise its employee in maintaining and operating its motor vehicles.
Saunders seeks trial by jury, compensatory damages, costs, attorney fees, pre and post-judgment interest and all other relief the court deems just and proper. He is represented by attorneys Paul R. Thomson, III of Thomson Law Firm, PLLC in Roanoke, and by L. Lee Javins, II of Bailey, Jarvis and Carter, LC in Charleston.
