Putnam County couple accuses Chase Bank of improper home loan

WINFIELD — A Putnam County couple is suing Chase Bank, alleging improper home loan servicing.

Robert J. Woods and Holly E. Woods filed a complaint Feb. 3 in Putnam Circuit Court against Chase Bank USA NA and JPMorgan Chase Bank NA,  alleging they violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, on March 1, 2016, Robert and Holly Woods noticed that after paying off a home mortgage since 2004, the balance of their loan did not reflect all the payments they had made. The suit says the plaintiffs have suffered economic injury and for spending time in dealing with the issue. 

The plaintiffs allege the defendants failed to credit their payments when received, improperly applied payments and late fees and unlawfully charged excessive fees.

Robert and Holly Woods seek trial by jury, actual damages of $1,000 for every violation of the act, disgorgement of any and all illegal or excessive fees paid to Chase, general damages and all other just and equitable relief. They are represented by attorneys Benjamin M. Sheridan and Daniel K. Armstrong of Klein & Sheridan LC in Hurricane.
