Raleigh County property owner alleges lender breached contract

BECKLEY — A Raleigh County property owner is suing Bank of America, alleging breach of contract.

Carla Ann Lynch filed a complaint Feb. 3 in Raleigh Circuit Court against Bank of America NA, doing business as BAC Home Loans Servicing LP, and Does 1-10, alleging they unfairly interfered with her right to the bargained benefits of the contract.

According to the complaint, in early 2016, Lynch began to worry that BAC Home Loans would never cooperate with her regarding a promissory note of $140,000 and that she would end up with the foreclosure of her home in Beckley.

The plaintiff alleges the defendants failed and refused to engage in a meaningful loan modification discussion until she fell behind on her mortgage.

Lynch seeks trial by jury, compensatory, consequential and punitive damages, court costs and interest, rescission and reformation of the note and all other proper relief. She is representing herself.
