NEW CUMBERLAND — A Tyler County man is suing a steel mill operator, alleging its negligence caused injuries to the plaintiff.
Tommy W. Phillips of Sisterville filed a complaint Feb. 6 in Hancock Circuit Court against Arcelormittal Weirton LLC, alleging failure to properly maintain its property to be free from a dangerous condition.
According to the complaint, on Feb. 16, 2015, Phillips was making delivery on behalf of his employer, Axiall LLC, to the defendant's plant in Weirton. While unloading the cargo, the suit says, a fixture believed to be a steel valve, which was sitting on top of a wall, fell on Phillips, causing him injuries.
The plaintiff alleges Arcelormittal Weiton failed to safely, properly and adequately dispose of its loose property, which subsequently fell and injured Phillips, leading to lost wages and an inability to enjoy life.
Phillips seeks trial by jury, compensatory damages in an amount to be determined at trial, attorney fees, court costs and pre- and post-judgment interest. He is represented by attorney Christopher M. Turak of Gold, Khourrey & Turak LC in Moundsville.
