BECKLEY — An Ohio company is suing a buyer and guarantor, alleging breach of contract.
LKQ 250 Auto Inc. of Harrisville, Ohio, filed a complaint Feb. 14 in Raleigh Circuit Court against Rightway Auto Corporation and Tony Solano, alleging failure to perform their contractual obligations.
According to the complaint, at the defendants' request, LKQ 250 Auto sold certain goods to the defendants on credit. After allowance for all proper credits for payments and returned merchandise, the suit says, the balance amount of $4,821.10 remains unpaid.
The plaintiff alleges Rightway Auto and Solano, despite demands for payment, have failed and refused to pay the due amount.
LKQ 250 Auto seeks trial by jury, judgment for $4,821.10, plus attorney fees of at least $865.65, costs of court and all other relief. It is represented by attorney John R. Keating of Amato, Keating an Lessa PC in Bethlehem, Pennsylvania.
