WILLIAMSON — A Mingo County married couple is suing a debt collection business, alleging intentional infliction of emotional distress and invasion of privacy.
Kayla and Matt Colegrove filed a complaint Feb. 16 in Mingo Circuit Court against Receivables Performance Management, alleging violation of the West Virginia Consumer Credit and Protection Act.
According to the complaint, on Nov. 1, 2016, during a phone conversation with the defendant's agent, the Colegroves informed the debt collector to stop contacting them and explicitly removed any authorization to call. However, the suit says, the plaintiffs still received telephone calls and voice messages from the defendant demanding payment.
As a result, the lawsuit states, the Colegroves have been annoyed, suffered emotional distress and harassed. The plaintiffs allege the defendant invaded, damaged and harmed the plaintiffs' right of privacy and engaged in unreasonable or oppressive or abusive conduct toward the plaintiffs in connection with the attempt to collect a debt.
The Colegroves seek trial by jury, statutory damages, cost of litigation including attorney fees, court costs and all other proper relief. They are represented by attorneys Benjamin Sheridan and Daniel K. Armstrong of Klein and Sheridan, LC in Hurricane.
