Mother accuses 21st Century Insurance of breaching contract

WILLIAMSON — A Mingo County woman is suing 21st Century Insurance, alleging breach of an insurance contract.

Melinda Edwards, as next friend of Kevin Edward Urban, a minor, filed a complaint Feb. 13 in Mingo Circuit Court against 21st Century Centennial Insurance Co., alleging the defendant breached its duty of good faith and fair dealing.

According to the complaint, on Dec. 25, 2015, Urban was injured in a vehicular accident while operating a motor vehicle owned by Edwards and was insured by 21st Century under the plaintiff's uninsured motorist coverage. Due to 21st Century's acts and omissions, Edwards and her son have suffered financial difficulties, inconvenience and emotional distress. 

The plaintiff alleges 21st Century maliciously disregarded Urban's rights under the insurance contract by refusing to compensate his damages.

Edwards seeks trial by jury, judgment in excess of the jurisdictional limits court, plus interest, court costs and all other appropriate relief. She is represented by attorney Jeffrey S. Simpkins of Simpkins Law Office PLLC in Williamson.
