WHEELING — A Wheeling mother and son are suing State Farm and medical care providers, alleging an unfair claims settlement.
Douglas Sarcopski and Sharon Sarcopski filed a complaint Feb. 15 in Ohio Circuit Court against State Farm Mutual Automobile Insurance Co., Dr. Richard B. Kasdan and Centre Commons MTI PC, alleging State Farm refused to acknowledge its liability.
According to the complaint, Douglas and Sharon Sarcopski have applicable under-insured motor vehicle insurance coverage. On April 3, 2009, the suit says Douglas Sarcopski was driving a motor vehicle owned by Sharon Sarcopski when they sustained severe injuries due to a vehicular accident in Wheeling caused by another driver.
Shortly afterward, the lawsuit states, the Scarcopskis made UIM (under-insured) claim for settlement, but were repeatedly denied.
The plaintiffs allege State Farm wrongfully refused to pay claims without conducting a reasonable investigation and failed too implement reasonable standards for prompt investigation of claims.
The plaintiffs seek trial by jury, compensatory, punitive and exemplary damages, pre- and post-judgment interest, attorney fees and court costs and all other just and proper relief. They are represented by attorneys Ronald W. Zavolta and Jordan M. Laird of Zavolta Law Office in Wheeling.
