Contractor alleges property owner, escrow agent owe nearly $38,000

WINFIELD — A contractor is suing a Putnam County property owner and escrow agent, alleging breach of contract.

Heritage Restoration Inc. filed a complaint Feb. 15 in Putnam Circuit Court against Daniel Bonnett and J.P. Morgan Mortgage Acquisition Corp., alleging failure to perform their contractual obligations.

According to the complaint, Heritage Restoration fully performed repair work on Bonnett's premises in Putnam County totaling $133.980.35. To date, the suit says, Bonnett is indebted to the plaintiff in the amount of $37,819.41 even though Heritage Restoration provided notice of a mechanic's lien unto Bonnett's property. 

The plaintiff alleges J.P. Morgan declared Bonnett in default upon payment, authorized the foreclosure of the deed of trust and retained the sums that were due the plaintiff.

Heritage Restoration seeks trial by jury, judgment against Bonnett for $37,819.41, plus costs of court, an order declaring the rights and legal status of the parties and all other relief. It is represented by attorney C. Joseph Stevens of Stevens & Stevens PLLC in Hamlin.
