PINEVILLE — Two Wayne County property owners are suing general contractors, alleging their negligent trespassing caused property damages.
Jerry Lynn and Julianne Maynard filed a complaint Feb. 16 in Wyoming Circuit Court against Bilco Construction Co. Inc. and Rock Forge Bridge Co. Inc., alleging they breached their duty to exercise reasonable care in using multi-ton industrial equipment.
According to the complaint, Lynn and Maynard sustained damages to their property, 16 Dillon Road, Genoa, including cracks or displacement of the exterior bricks and masonry, interior dry wall, door frames and ceramic tile. The plaintiffs allege the defendants dismantled and demolished a hillside adjacent to the plaintiffs' real estate using industrial equipment that created vibrations to the plaintiffs' home.
Lynn and Maynard seek trial by jury, judgment, jointly and severally, to compensate them for damages to their home, cost of repair, diminution of the residue value of the home, attorney fees and court costs, plus interest.
