Student accuses W.Va. State of wrongfully charging fees

CHARLESTON – A student is suing West Virginia State University after he claims it has wrongfully been charging extra fees to students.

Dr. Anthony L. Jenkins was also named as a defendant in the suit.

Seth Lilly claims the university has been wrongfully charging students, mostly commuter students, with a commuter fee, according to a complaint filed in Kanawha Circuit Court.

“I have proven that this fee is not on the schedule of fees, even though students rely on this schedule when deciding how much loans he or she needs to take out for school expenses,” Lilly wrote in his complaint.

WVSU has also intentionally misrepresented the meal plan for nearly four years, and Lilly believes it has used the funds from the commuter fee for other purposes.

Lilly claims the purposes are not yet 100 percent known because the public request he made has not yet been received by him.

The plaintiff is seeking $100,000 for financial burden and misrepresentation. He is also seeking to have all other students’ money returned to them. He is representing himself

The case is assigned to Circuit Judge James Stucky.
