Couple blames mining operators for husband's injuries

LOGAN — A Logan County couple is suing Charleston-based mining operators, alleging negligence led to injuries to the husband.

Brandon Crum and Denise Crum filed a complaint Feb. 17 in Logan Circuit Court against Coal-Mac LLC and Arch Coal Inc., alleging failure to provide a safe working environment.

According to the complaint, on Feb. 25, 2015, Brandon Crum was in the course and scope of his employment as a welder with the defendants at the Holden No. 22 surface mine in Holden. The suit says Crum was working on a scaffolding 6 feet above the ground when he fell violently to the ground after the scaffolding broke. 

The lawsuit states Crum sustained severe and permanent injuries, resulting in physical impairment, pain and suffering, lost wages and medical expenses. Denise Crum alleges she has been deprived of society and consortium of her husband. 

The plaintiffs allege the defendants negligently allowed the scaffolding to be in state of disrepair and failed to properly train and supervise their employees.

The Crums seeks trial by jury, judgment, jointly and severally, in an amount to be determined at trial, costs of court and all other just and proper relief. They are represented by attorneys Karen S.
