Injured employee accuses Charleston hospital of wrongful termination

Wrongful term 12

CHARLESTON — A Putnam County woman is suing Charleston hospital operators, alleging disability discrimination and wrongful termination.

Bani G. Shabdue filed a complaint Feb. 15 in Kanawha Circuit Court against Charleston Area Medical Center Inc., alleging violation of the West Virginia Code.

According to the complaint, on Oct. 5, 2016, Shabdue was terminated from her employment. This suit says the termination followed almost a week after she had informed the medical center that she would not be able to work due to a serious shoulder injury she had received at work. The plaintiff alleges Charleston Area Medical Center refused to provide proper medical referrals and to accommodate her injury and terminated her employment for attempting to receive workers compensation benefits.

Shabdue seeks trial by jury, judgment equal to her lost back pay and benefits, reinstatement or front pay, compensatory and punitive damages, attorney fees and court costs and all other equitable relief. She is represented by attorneys J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices in Charleston, and by G. Patrick Jacobs of Jacobs Law Office in Charleston.
