Estate executor blames nursing home caregivers for resident's death

CHARLESTON — A Raleigh County man is suing a nursing home caregivers, alleging their negligence led to injuries and the death of a resident.

Stanley Harrell, executor of the estate of Ethel Harrell, filed a complaint Feb. 16 in Kanawha Circuit Court against Riparian Investments LLC, doing business as Harper Mills LLC, alleging the nursing home caregivers negligently deviated from applicable standards of medical care.

According to the complaint, on Jan. 15, 2015, Ethel Harrell was admitted at the defendant's Harper Mills Nursing Home in Beckley. On Feb. 16, 2015, the suit says, her functional status declined. Two days later her attending physician, upon her family's request, ordered her transferred to Raleigh General Hospital, the lawsuit states. 

Harrell died less than 24 hours later from sepsis and pneumonia, both conditions, she developed while she was a patient at Harper Mills, the lawsuit says. Stanley Harrell says he suffered sorrow, loss of society and guidance. 

The plaintiff alleges Harper Mills failed to provide adequate water and food to prevent injury and death and failed to sufficiently monitor and treat Ethel Harrell's worsening condition.

Stanley Harrell seeks trial by jury, judgment in an amount that will adequately compensate his damages, plus interest, litigation costs and all other general and proper relief. He is represented by attorneys William M. Tiano and Cheryl A. Fisher of Tiano O'Dell PLLC in Charleston.
