CHARLESTON — The state insurance commissioner is suing a company for alleging failing to obtain workers' compensation coverage.
The state of West Virginia er rel. Offices of the West Virginia Insurance Commissioner filed a complaint Feb. 21 in Kanawha Circuit Court against Apanowicz Enterprises Inc., Stanley Apanowicz and Gregory Apanowicz, alleging they violated the laws of the Offices of the Insurance Commissioner.
According to the complaint, due to the defendants' unlawful actions, the state, and other employees and claimants served by the plaintiff, as well as West Virginia taxpayers, suffered irreparable harm. The plaintiff alleges the defendants failed to obtain and/or maintain workers compensation insurance coverage.
The state of West Virginia seeks trial by jury, an order enjoining the defendants from doing business in West Virginia until all fines and penalties are satisfied and to obtain valid worker's compensation coverage for themselves and costs of court.
