Couple sues Allstate Construction for breach of contract

NEW MARTINSVILLE – A New Martinsville couple is suing Allstate Construction after they claim the construction company breached its contract with them.

Fred Hlad is doing business as Allstate Construction.

On June 5, 2015, Dwight Law and Jane Hafer entered into a construction contract with Hlad to build a 20-feet by 42-feet addition on their residence in New Martinsville and the contract stated the price for material and labor was $184,700 and the job would begin within 21 days of signing the contract, according to a complaint filed Feb. 4 in Wetzel Circuit Court.

Law and Hafer claim on July 27, 2015, the contract was amended to include an additional 15 terms, allowances and a draw scheduled.

The original completion date was Oct. 22, 2015, however, the plaintiffs gave Hlad an extension of 39 days to complete the work, according to the suit.

The plaintiffs claim to date, the work has not been completed and the work that has been completed has been done in a dangerous, negligent and substandard manner.

The plaintiffs have paid the defendant the sum of $191,448.28 toward the contract and the extra retaining wall, according to the suit.

The plaintiffs are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Andrea C. Poling of Berry, Kessler, Crutchfield, Taylor & Gordon.
