MOUNDSVILLE — A Marshall County woman is suing a Moundsville property owner, alleging negligence led to injuries for the plaintiff.
Kathleen Rose Tuttle filed a complaint Feb. 22 in Marshall Circuit Court against ELJAC Realty Inc. alleging the defendant failed to maintain its premises in a reasonably safe manner.
According to the complaint, on Feb. 23, 2015, after parking her vehicle in the defendant's property known as Elby's Plaza, Tuttle fell in the parking lot walkway area due to the hidden accumulated snow and ice, striking her arm and elbow. As a result, Tuttle says she suffered physical injuries, lost wages and incurred medical expenses of $24,000.
The plaintiff alleges ELJAC Realty failed to conduct reasonable inspection of the premises, failed to warn invitees of the hidden and latent unsafe condition on its premises and failed to comply with the municipal ordinance concerning ice and snow removal.
Tuttle seeks trial by jury, all damages, pre and post-judgment interests, costs, attorney fees and all other appropriate relief. She is represented by attorney Robert G. McCoid of McCamic, Sacco and McCoid, PLLC in Wheeling.
