Lester resident alleges General Motors failed to properly repair new Chevrolet Malibu

PINEVILLE — A Lester resident is suing General Motors LLC, an automobile manufacturer, citing alleged breach of express and implied warranties.

Misty Kruse filed a complaint on Feb. 21 in the Wyoming Circuit Court against General Motors alleging that the automobile manufacturer failed to comply with the New Motor Vehicle Warranty Act.

According to the complaint, the plaintiff alleges that in April 26, she purchased a new 2016 Chevrolet Malibu from Crossroads Chevrolet for $37,465.50. Within the warranty period, the vehicle has been in the shop with the same non-conformities subject to repair over three times. The non-conformities substantially impaired its use, value and safety. The plaintiff holds General Motors responsible because the defendant allegedly failed to repair the vehicle to ensure it conformed with the warranty.

The plaintiff seeks the refund of the purchase price, award for incidental and consequential damages, attorney's fees and costs. She is represented by Timothy P. Lupardus of Lupardus Law Office in Pineville
