Husband and wife accuse doctor of medical negligence after two knee surgeries, infection

PRINCETON — A Bluefield couple is suing Dr. Gary P. McCarthy, an orthopedic surgeon, alleging he took insufficient measures after performing knee replacement surgery to prevent and treat a subsequent infection.

Margaret and Eric Kidd filed a complaint in Mercer Circuit Court against McCarthy, claiming he breached the standards of medical care required of his profession.

According to the complaint, Margaret Kidd underwent total knee replacement surgery performed by McCarthy at Bluefield Regional Medical Center in February 2014. After the initial surgery – and following a revision surgery nearly a year later when the prosthesis failed prematurely – Margaret Kidd allegedly continued to suffer pain, swelling and lack of ability to bear her weight and was diagnosed with septic and abscess of right knee. Plaintiff Eric Kidd allegedly suffered loss of consortium and service of his wife. The plaintiffs hold McCarthy responsible because the surgeon allegedly failed to identify the cause of Margaret Kidd's premature total knee replacement failure and failed to properly test for infection at the time of the revision surgery.

The plaintiffs request a trial by jury and seek compensatory damages, interest and such other and further relief. They are represented by Eric J. Buckner of Katz, Kantor, Stonestreet & Buckner in Princeton and Mark R. Staun of Hartley Law Group in Wheeling.
