Maintenance technician sues former employer

WINFIELD — A maintenance technician is suing his former employer, Diamond Electric Mfg. Corp., citing alleged violation of the Family and Medical Leave Act.

Charles R. Kinney filed a complaint on Feb. 24, in the Putnam Circuit Court against Diamond Electric, alleging that the former employer also violated the West Virginia Human Rights Act.

According to the complaint, the plaintiff was unlawfully terminated from his employment alleges on Feb. 27, 2015. The employer's actions caused him to suffer lost wages and benefits and severe emotional distress. The plaintiff holds Diamond Electric responsible because the company allegedly refused to provide reasonable accommodations and retaliated against him by terminating his employment for attempting to take time off due to a heart condition.

The plaintiff requests a trial by jury and seeks unconditional reinstatement, back pay, punitive damages, interest, costs of this action and all other relief. He is represented by Robert H. Miller II of The Sutter Law Firm PLLC in Charleston.
