Subcontractor alleges property owner, insurer breached contract

FAYETTEVILLE — A Fayetteville subcontractor is suing a contractor, property owner and insurer, alleging breach of contract.

Dean Paving Co. Inc. filed a complaint Feb. 27 in Fayette Circuit Court against Freeland Construction Co. Inc., National Railroad Passenger Corp.(Amtrak) and Aegis Security Insurance Co., alleging they failed to comply with the subcontractual agreement.

According to the complaint, on June 21, 2016, Dean Paving entered into a subcontracting agreement with Freeland to perform asphalt paving for Amtrak for the sum of $19,000. The suit says the plaintiff did not receive full payment. 

The plaintiff alleges the defendants failed and refused to make payments for the materials and labor provided by plaintiff.

Dean Paving seeks trial by jury, compensatory damages, interest, costs of court and all other relief. It is represented by attorney Thomas K. Fast of Fast Law Office LC in Fayetteville.
