Property owner accuses loan servicer, holder, purchaser of illegal foreclosure

WEST UNION — A Doddridge County property owner is suing a loan servicer, holder and purchaser, alleging an illegal foreclosure.

Robert G. Conrad of New Milton filed a complaint Feb. 27 in Doddridge Circuit Court against Ocwen Loan Servicing LLC, U.S. Bank National Association and Dakota Hinterer, alleging they failed to comply with the industry standards in servicing a loan.

According to the complaint, as a result of the defendants' illegal actions, Conrad, a disabled chef, has suffered economic loss, annoyance, stress and fear of losing his home. On Jan. 18, the suit says, his home was sold at foreclosure. 

The plaintiff alleges the the defendants failed to credit payments, refused to honor a loan modification, failed to consider the plaintiff for loss mitigation assistance and illegally sold his home at foreclosure.

Conrad seeks trial by jury, actual damages, cost of court, and all other just and equitable relief. He is represented by attorneys Michael C, Nissim-Sabat and Jennifer S. Wagner of Mountain State Justice Inc. in Clarksburg.
