Mine services firm sued over worker's termination

LOGAN — An Amherstdale man is suing a former employer, Strata Mine Services LLC, alleging a violation of human rights in the wake of his termination from the company two years ago.

Jonathan Sword filed a complaint on Feb. 27 in the Logan Circuit Court against the Strata Mine Services, Strata Prodcts Worldwide LLC and Strata Worldwide Holdings Inc. Sword alleges they violated the West Virginia Human Rights Act after he took time off to recover from a ruptured lung that resulted from bronchitis..

According to the complaint, the plaintiff alleges he was terminated from his employment on March 16, 2015, and subsequently suffered lost wages and benefits, indignity, embarrassment and emotional distress. The plaintiff holds the companies responsible because they allegedly failed to provide reasonable accommodations, discriminated against him and terminated his employment due to his disability or perceived disability.

The plaintiff requests a trial by jury and seeks compensatory damages, interest, reinstatement, attorney's fees and costs and other relief. He is represented by Steven S. Wolfe of Wolfe, White & Associates in Logan.
